Law on Geodetic Activities
REAL ESTATE PROPERTY, NATIONAL BORDER AND SPATIAL UNITS REGISTRATION BILL
Organizational Regulations
The organization of performing the geodetic tasks is regulated by the following acts:
the Geodetic Activities Act (Official Journal of the Republic of Slovenia, 2000, No.8),
the Administration Act (Official Journal of the RS, 1994, No. 67),
the Organization and the Ministries' Sphere of Work Act (Official Journal of the RS: 1994, No. 71; 1997, No. 47 and 2001, No. 30).
On the basis of the Geodetic Activities Act, the following executive regulations were adopted:
the Regulation governing the setting up the regional geodetic administrations of the Surveying and Mapping Authority of the Republic of Slovenia, their regions and head offices (OJ of the Republic of Slovenia, 2000, No. 49);
the Regulations on the programme and the mode of sitting for the professional examination any geodetic inspector must pass (OJ of the Republic of Slovenia, 2000, No. 55);
the Regulations on the conditions referring to the premises and technical equipment needed for geodetic companies (OJ of the Republic of Slovenia, 2000, No. 67);
the Order referring to transforming the Geodesy and Photogrammetry Institute of the Faculty of Civil Engineering and Geodesy into the GEODETIC INSTITUTE OF SLOVENIA (OJ of the Republic of Slovenia, 2000, No. 84);
the Regulations on the programme and the mode of sitting for the examination in the geodetic profession (OJ of the Republic of Slovenia, 2000, No. 99);
the Regulations on the programme of a special professional examination needed to be passed for performing geodetic services and on the method of testing the knowledge of the Slovene language (OJ of the Republic of Slovenia, 2000, No. 105);
the Regulations on the changes and amendments of the regulations on the form and contents of the uniform stamps of the project-oriented companies (OJ of the Republic of Slovenia, 2000, No. 68);
the Regulations on the types and contents of confirmations from the geodetic data collections (OJ of the Republic of Slovenia, 2000, No. 113);
the Regulations on the geodetic card, on its issue procedure and on its mode of application.
In January 2000, the National Assembly of the Republic of Slovenia passed the new Geodetic Activities Act, as the earlier regulation of the geodetic activities regulated by the Geodetic Service Act (OJ of the Socialist Republic of Slovenia, 1976, No. 23) no longer complied with the modified conditions or it made the geodetic activity modernisation difficult in the administrative and technical spheres. Most executive regulations defined by the Act was passed in 2000.
Material Regulations
The predominant part of geodetic activities is regulated by:
the Recording of Real Estate, State Border and Spatial Units Act (Official Journal of the Republic of Slovenia, 2000, No. 52),
the Basic Geodetic Measurements Act (Official Journal of the SRS, 1974, No. 16, and Official Journal of the SRS, 1986, No. 42),
the Naming and Recording of Settlements, Streets and Buildings Act (Official Journal of the SRS, 1980, No. 5, and Official Journal of the SRS, 1986, No. 42).
In May 2000, the National Assembly of the Republic of Slovenia passed the new Recording of Real Estate, State Border and Spatial Units Act, which began to be applied on 28 December 2000, and it substituted the Land Cadastre Act (Official Journal of the SRS, 1974, No. 16, and Official Journal of the SRS, 1986, No. 42). This Act provides uniform registration of real estate and quality data on real estate, which are the basis for the space economy, land policy administration, real estate taxation, keeping records of substantial rights on real estate, for the spatial definition of data, and other purposes. Regulated real estate registration is conditioned by already adopted international liabilities (in the fields of the environment, statistics, foreigners title to real estate…), and primarily by the process of joining the European Union.
Activities in the past year
As the National Assembly of the Republic of Slovenia passed the two new geodetic acts: the Geodetic Activities Act and the Recording of Real Estate, State Border and Spatial Units Act in 2000, the activities for preparing and adopting some executive regulations and issuing the instructions for implementing the acts have started. |
